These General Rules, in addition to any contest/sweepstakes-specific rules (the “Specific Rules”), shall govern all contests or sweepstakes (each a “Promotion” and collectively, “Promotions”) conducted by The RVA Agency, owner and/or operator of 804radio, including associated websites, social media pages, livestreams, broadcasts, and digital platforms (collectively with The RVA Agency, the “Station”), including without limitation on-air, online, mobile, text-based, livestream, social media, and website Promotions.

In the event of a conflict or inconsistency between these General Rules and any Specific Rules, these General Rules shall govern unless otherwise stated.

Any individual who enters, attempts to enter, or in any way participates or attempts to participate in a Promotion agrees to be bound by these General Rules, any applicable Specific Rules, and all decisions made by the Station, which shall be final and binding in all matters relating to the Promotion.

1. Eligibility

No purchase is necessary to enter or win. A purchase will not improve your chances of winning.

All applicable federal, state, and local laws and regulations apply. Void where prohibited by law.

Unless otherwise specified in the Specific Rules, Promotions are open only to legal residents of the United States who are at least eighteen (18) years old at the time of entry.

Employees, contractors, affiliates, sponsors, prize providers, or promotional partners of The RVA Agency, 804radio, and any entities directly associated with the administration of the Promotion, along with their immediate family members and household members, are not eligible to participate or win unless otherwise stated.

2. Entries

Participants must provide truthful and accurate information. The Station reserves the right to reject or remove any entry suspected to be false, fraudulent, incomplete, offensive, defamatory, inappropriate, or in violation of intellectual property rights.

Use of bots, automated systems, scripts, fake accounts, or mechanical entry methods is prohibited and may result in immediate disqualification.

Entries become the property of the Station and will not be returned.

The Station is not responsible for lost, late, incomplete, invalid, corrupted, misdirected, or technically malfunctioning entries.

Where applicable, entries shall be deemed made by the authorized account holder associated with the submitted email address, social media account, or mobile number.

3. Verification of Potential Winners

Potential winners are subject to verification by the Station.

Potential winners may be required to:

• Provide valid identification

• Sign eligibility affidavits

• Sign liability/publicity releases

• Complete tax documentation

• Verify ownership of the account used to enter

Failure to comply within the requested timeframe may result in forfeiture of the prize.

The Station reserves the right to conduct background checks where legally permissible and may disqualify any participant whose conduct could damage the reputation of the Station or Promotion.

4. Prizes

No substitution, transfer, or cash redemption of prizes is permitted except at the Station’s sole discretion.

The Station reserves the right to substitute a prize of equal or greater value if a listed prize becomes unavailable.

Unless otherwise specified:

• Winners are responsible for all taxes and expenses

• Event tickets are subject to venue policies

• Travel prizes do not include incidental expenses

• Vehicle prizes require proof of insurance and a valid driver’s license

• Gift cards and certificates are subject to issuer terms

Prizes are awarded “as-is” without warranties of any kind.

5. Taxes

All federal, state, and local taxes associated with prizes are the sole responsibility of the winner.

An IRS Form 1099 may be issued where required by law.

6. Release and Indemnification

By participating in any Promotion, participants agree to release, indemnify, defend, and hold harmless:

• Sponsors

• Promotional partners

• Prize suppliers

• Advertising agencies

• Affiliates

• Employees

• Officers

• Directors

• Agents

• Representatives

(collectively referred to as the “Released Parties”)

from and against any and all claims, liabilities, damages, losses, injuries, costs, or expenses arising from or related to:

• Participation in the Promotion

• Acceptance or use of prizes

• Technical malfunctions

• Publicity usage

• Travel or event participation

• Promotion administration

• Social media participation

• Website usage

Participants further acknowledge that Promotions are not sponsored, endorsed, administered by, or associated with Facebook, Instagram, X/Twitter, TikTok, YouTube, Live365, or any other social media or streaming platform unless explicitly stated otherwise.

7. Publicity Release

Unless prohibited by law, participation in a Promotion constitutes permission for the Station and Released Parties to use the participant’s:

• Name

• Voice

• Photograph

• Likeness

• Social media handle

• Biographical information

• Statements

for promotional, advertising, marketing, broadcast, website, streaming, social media, and publicity purposes in any media now known or later developed without additional compensation.

8. General Conditions

The Station reserves the right to cancel, suspend, modify, or terminate any Promotion at any time for any reason, including fraud, technical failures, or circumstances beyond the Station’s control.

The Station may disqualify any participant found to:

• Tamper with the entry process

• Violate the rules

• Use fraudulent methods

• Harass or threaten others

• Attempt to disrupt the Promotion

Any attempt to deliberately damage or undermine the legitimate operation of a Promotion may violate criminal and civil laws.

9. Limitation of Liability

The Released Parties are not responsible for:

• Incorrect or inaccurate information

• Technical failures

• Internet interruptions

• Unauthorized intervention

• Human error

• Lost or delayed entries

• Injuries or damages related to participation or prize usage

Participation is at the participant’s own risk.

10. Arbitration and Governing Law

Any disputes arising out of or related to a Promotion shall be resolved individually through binding arbitration in the Commonwealth of Virginia.

Participants waive the right to:

• Jury trials

• Class actions

• Punitive damages

• Consequential damages

These rules shall be governed by the laws of the Commonwealth of Virginia.

11. Privacy

Information collected from participants may be used by the Station for Promotion administration, marketing, audience engagement, and future promotional communications in accordance with applicable privacy laws.
